ANJANA MISHRA ORAL ORDER 16-02-2015 Heard learned counsel for the petitioners and the learned counsel for the State.

The petitioners are in custody since 26.7.2014 in connection with Balua (Birpur) P.S. Case No.137 of 2014 registered for the offences under Sections 307 and other sections of the Indian Penal Code.

It is submitted on behalf of the petitioners that the petitioners have been falsely implicated in the present case on account of previous enmity and there is no independent witness to support the F.I.R. It is further submitted on behalf of the petitioners that the injury report reveals and belies the prosecution case as stated in the F.I.R.

No.46412 of 2014 (3) dt.16-02-2015 2/2 Considering the facts that there was previous enmity between the parties and that the petitioners have no criminal antecedents and also the fact that they have been in custody for more than six months, let the above named petitioners be released on bail on their furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, (Birpur), Supaul, in connection with Balua (Birpur) P.S. Case No.137 of 2014.
