The petitioner apprehends his arrest in connection with Sadar P.S. Case No. 417 of 2018, registered under Sections 399, 402 and 414 of the Indian Penal Code read with Sections 25(1-b)A/26/35 of the Arms Act.
Learned counsel for the petitioner submits that it would appear from the F.I.R. that co-accused, Mayank Kumar , Kanhai Kumar, Brajesh Kumar and Chandan Kumar were apprehended while some others succeeded to flee away in course of preparing of committing Dacoity and two motorcycles bearing registration no. BR06-AJ-4942 and BR06-AJ-6054 and one Centro car bearing registration no. BR015-3806 were
Patna High Court Cr.Misc. No.56080 of 2018(3) dt.05-02-2019 2/2 seized. The apprehended persons disclosed the name of their associates including the name of petitioner saying that motorcycle bearing registration no. BR06-AJ-6054 was belonging to the petitioner. It is, further, submitted that the motorcycle bearing registration no. BR06-AJ-6054 is not belonging to the petitioner and up till now, the police has not verified the fact that whether the motorcycle bearing registration no. BR06-AJ-6054 is of petitioner or not, which would appear up to paragraph 64 of the case dairy.
Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur, in connection with Sadar P.S. Case No. 417 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
