JUSTICE SANJAY PRIYA ORAL ORDER 12-07-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Madhubani Mahila P.S. Case No. 85 of 2016 corresponding to G.R. No. 1945 of 2016 instituted for the offence under Sections 498(A), 504, 494, 379, 384 of the Indian Penal Code and Sections 3/4 of Dowry Prohibition Act.

Petitioner is husband of the complainant. The matter was sent to Mediation Centre and the report of Mediator has been received. As per report of the Mediator, the parties could not resolve the dispute.

Learned counsel for the opposite party No. 2 has

Patna High Court Cr.Misc. No.18524 of 2017 (3) dt.12-07-2017 2/2 submitted that petitioner has earlier offered to pay Rs.4,000/- to the complainant but later on he refused to make payment. It has further been submitted that petitioner lives in Nepal and wants his wife to live at his village home along with his minor child. He is totally neglecting his wife and child.

From the conduct of the petitioner it appears that he committed mental and physical tortured with his wife along with the minor child.

Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.

Prayer for anticipatory bail of the petitioner stands rejected.
