JUSTICE ASHUTOSH KUMAR ORAL ORDER 13-07-2021 Heard Ms. Rina Sinha, learned Advocate for the petitioners and the learned APP for the State. The petitioners seek bail in anticipation of their arrest in connection with Bhagwanpur P.S. Case No. 201 of 2020 dated 17.08.2020 instituted for the offences under Sections 304(B), 201 and 34 of the Indian Penal Code.

The accusation in the FIR is that the petitioners along with others conspired and killed the deceased. Learned counsel for the petitioners has submitted that the petitioner no. 2 is the sister-in-law of the deceased who got married to petitioner no. 1 about 15 years ago. It has further been submitted that only

No.1778 of 2021(2) dt.13-07-2021 2/2 because the deceased has died in her matrimonial home, all the relatives of the husband of the deceased have been made accused in this case. The petitioners do not have any control over the affairs of the family of the deceased or her husband.

Regard being had to the general nature of accusation and the relationship of the petitioners with the deceased, they are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajiopur in connection with Bhagwanpur P.S. Case No. 201 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Ashutosh Kumar, J) krishna/- U T
