Mr. None ====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 08-10-2018 Heard Sri Ajay Kumar Pandey, learned counsel for the petitioners. None appeared on behalf of the State. Two petitioners, apprehending their arrest in Darouli P.S. Case No. 281 of 2017, registered for the offence under Sections 30(a), 37(c) of the Bihar Prohibition and Excise Act, 2016, have prayed for grant of bail, in the event of their arrest or surrender.
At the very outset, it was submitted by learned counsel for the petitioners that since on last occasion both the petitioners were apprehended in drunken condition, in the present case also, petitioners have falsely been implicated on the basis of confessional statement of co-accused, who was arrested in a car and from the said car, only one litre of country-made
Patna High Court Cr.Misc. No.55995 of 2018(3) dt.08-10-2018 2/2 liquor was shown to be recovered.
Considering the nature of accusation and meagre amount of recovery of liquor, in the event of their arrest or surrender within a period of six weeks from today, let both the aforesaid petitioners, namely, (i)Navin Singh @ Navin Kumar Singh and (ii) Piyush Singh be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-II-cum Special Excise Judge, Siwan in connection with Darouli P.S. Case No. 281 of 2017, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
