JUSTICE ASHUTOSH KUMAR ORAL ORDER 10-12-2018 The petitioner seeks bail in anticipation of his arrest in connection with Samastipur Mufassil P.S. Case No. 350 of 2018 instituted for the offences under Sections 448, 354A, 354B, 354D, 504, 506 of the Indian Penal Code and Section 12 of the Protection of Children From Sexual Offences Act, 2012.
Regard being had to the nature of accusation levelled in the F.I.R., this Court is not inclined to grant anticipatory bail to the petitioner.
However, since the informant of the case is the
Patna High Court Cr.Misc. No.56663 of 2018(3) dt.10-12-2018 2/2 uncle of the petitioner and there is a Title Suit pending between the parties, this Court observes that in the event of the petitioner surrendering before the Court below within a period of four weeks from today and praying for bail, the Court below shall look into the aforesaid facts and pass orders in accordance with law without being prejudiced by the fact that the present anticipatory bail petition has been rejected by this Court.
The petition is dismissed with the aforesaid observation.
