JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 13-04-2021 Heard learned counsel for the petitioner and learned APP for the State through virtual court proceedings. The petitioner seeks bail in a case registered for the offence punishable under Sections 302/34 of the Indian Penal Code and Section 3 and 4 of the Explosive Substance Act. Allegation against the petitioner is that he along with others came and started abusing the informant's husband and on protest, hurled two bombs upon informant's husband resultantly her husband died at the spot while grand daughter of the informant sustained injuries on the leg.
Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case. He submits that there is no allegation of any overt act against the petitioner. He submits that specific allegation is upon co-accused Pramod Yadav and not against the petitioner. He
Patna High Court CR. MISC. No.2540 of 2021(3) dt.13-04-2021 2/2 submits that similarly situated co-accused have been granted bail by coordinate Bench of this Court in Cr. Misc. No. 3043 of 2021 on 10.03.2021. He further submits that petitioner has no criminal antecedent as stated in para-3 of the bail application and he is languishing in judicial custody since 10.09.2020. In the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Amarpur (Fullidumar) P.S. Case No. 298 of 2020.
