The present application has been filed for cancellation of the anticipatory bail granted to Opposite Party No. 2 by the learned Additional Sessions Judge-IX, Samastipur, Bihar, vide order dated 03.02.2020, in connection with Ujiarpur P.S. Case No. 267 of 2019, registered under Sections 323, 341, 504, 506, 34, and 498A of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.

3. Learned counsel for the petitioner submits that the anticipatory bail was granted on the basis of settlement between the parties and the assurance given by Opposite Party No. 2 to

Patna High Court CR. MISC. No.56847 of 2021(5) dt.21-07-2026 2/2 resume matrimonial life, but after obtaining bail, he failed to honour the settlement.

4. Considering the facts and circumstances of the case and the materials available on record, this Court finds no sufficient ground for cancellation of the anticipatory bail granted to Opposite Party No. 2. No material has been brought on record to show misuse of the privilege of bail. 5.

Accordingly, the present application for cancellation of anticipatory bail stands dismissed.

6. However, the learned Trial Court is directed to expedite the trial and conclude the same as early as possible, preferably within a period of six months from the date of this order. The learned Trial Court shall submit a compliance report before this Court after expiry of the said period.
