Petitioners, in the present case, are seeking anticipatory bail in connection with Bihta P.S. Case No. 545 of 2018 registered for the offences punishable under Sections 341, 323, 324, 354(K)(IV) and 379/34 of the Indian Penal Code. Learned counsel for the petitioners submits that so far as these petitioners are concerned, the allegations against them are that they were among the co-accused who have misbehaved with the girls. The allegation of causing injury to the informant by knife blow is specifically attributed to one Alok Kumar. The allegation of snatching of Rs.700/- is also attributed to the coaccused Ravi Kumar. Learned counsel further submits that similarly situated co-accused Lallu Kumar has been granted
Patna High Court Cr.Misc. No.57774 of 2018(3) dt.22-01-2019 2/2 privilege of anticipatory bail by a learned coordinate Bench of this Court in Cr.Misc.No.48140 of 2018, a copy of which has been enclosed as Annexure-2 to the present application. Learned APP for the State is present and has opposed the prayer for bail.
In the given facts and circumstances wherein the specific allegations are not attributed to these petitioners, in case of arrest or surrender of the petitioners within a period of four weeks from today, the abovenamed petitioners shall be enlarged on bail on furnishing bail bond of Rs.15,000/- (rupees fifteen thousand) each with two sureties of the like amount each to the satisfication of the learned A.C.J.M.-I, Danapur in connection with Bihta P.S. Case No. 545 of 2018, subject to the condition that petitioners shall join the investigation by reporting to the Investigating Officer within a period of two weeks from today and shall cooperate in course of investigation. This will be in addition to condition prescribed under Section 438(2) of the Cr.P.C.
