JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-02-2020 This application has been filed for cancellation of bail granted to opposite party nos. 2 learned Session Judge, Nalanda, vide order dated 22.10.2014 passed in B.P. No. 905 of 2014 in connection with Laheri P.S. Case No. 217/2014, registered for offences punishable under Sections 419, 420, 406 and 120(B) of the Indian Penal Code.

Ground taken by the petitioner for cancellation of bail of opposite party no. 2 is that he has falsely submitted before the Court below that he is not the Director of the company and he has been granted bail on the basis of above submission as well as on the basis of period of detention in judicial custody, which is not just and proper, as such, he has moved this court for cancellation of bail of opposite party no. 2. Heard learned A.P.P. and perused the impugned order,

No.58176 of 2018(4) dt.24-02-2020 2/2 from which, it appears that the learned Sessions Judge after considering the period of custody of opposite party no. 2 as well as other materials available on record has granted bail to opposite party no. 2 in the year 2014 and after almost four years, this application has been filed for cancellation of bail and further there is no case of misuse of privilege of bail or tampering with the evidence against the opposite party no. 2 In view of the above discussions, I find no merit in this application, same is, accordingly, dismissed (Vinod Kumar Sinha, J) sunilkumar/- U T
