JUSTICE ASHUTOSH KUMAR ORAL ORDER 13-08-2021 Heard the Mr. Gagandeo Yadav, learned counsel for the petitioner and Mr. Shailendra Kumar Jha, learned counsel for the informant. The State is represented by Ms. Asha Devi, learned APP.

The petitioner seeks bail in anticipation of his arrest in connection with Parsa P.S. Case No. 65/2020 instituted for the offences under Sections 147, 148, 149, 341, 323, 324, 307 and 379 of the Indian Penal Code. The accusation in the F.I.R. is that all the accused persons including the petitioner assaulted the informant and others leading to injuries on five victims.

Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.1163 of 2021(2) dt.13-08-2021 2/3 that he is said to have assaulted one Ritesh Kumar who has not suffered any injury. The injuries on five persons have been reported to be simple in nature. There is a counter version of the occurrence also vide Parsa P.S. Case No. 68 of 2020, in which two of the persons from the side of the petitioner have been injured and they had to be referred to PMCH for better treatment. The aforesaid two persons have received injuries on their head.

Regard being had to the aforesaid background facts, the petitioner, above named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -II, Saran at Chapra, in connection with Parsa P.S. Case No. 65/2020, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

While saying so this Court has also taken note of
