The petitioner seeks pre-arrest bail in Kotwali P.S.Case No.78 of 2018 registered under Sections 406, 409 and 120(B) of I.P.C.

Accusation is that the petitioner along with two other officials of Max Life Insurance approached the informant for taking the single premium Policy of the Max and to get appropriate profits thereupon and the complainant took the single premium policy paying Rs.50,00,000/- in the name of his son and the money was paid through his Firm. When the policy paper was handed over to him then he came to know that the paper was not related to single premium policy and

Patna High Court Cr.Misc. No.64455 of 2018(3) dt.06-02-2019 2/2 Rs.50,00,000/- was to be deposited per year for five years and maturity of insurance was ten years. As such, the petitioner and other officials cheated him.

Learned counsel appearing on behalf of the petitioner submits that, in fact, after taking the benefit of Rs.50,00,000/- in Income Tax, the complainant approached the petitioner for converting regular premium policy to single premium policy and that has already been done which would appear from Annexure-11 to this petition. Further submission is that the petitioner is an official of Max Life Insurance having no criminal antecedent.

Having considered the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned C.J.M., Patna, in connection with Kotwali P.S.Case No.78 of 2018 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
