The petitioner seeks bail in Cheriabariyarpur P. S. Case No. 33 of 2019 instituted for the offence under Section(s) 25(1-b)a, 26(ii) and 27 of the Arms Act.

It is alleged that one country made pistol along with five live cartridge have been recovered from possession of petitioner. Seizure list is part of the FIR. It is mentioned in the seizure list that recovery has been made from Manjhaul Pustkalay Chowk in front of the cement shop of Gopal Singh. Petitioner is in custody since 8.3.2019 having clean antecedent.

Keeping in view the clean antecedent and period of

No.45647 of 2019(2) dt.30-07-2019 2/2 custody, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M. Manjhaul, Begusarai, in connection with in (Manjhaul O.P.) Cheriabariyarpur P. S. Case No. 33 of 2019 subject to the following conditions:- (i) Both the bailors shall be the close relative of the petitioner.

(ii) The petitioner shall be present on each and every date fixed by the Court and absence on two consecutive dates without valid reason will result in cancellation of bail bond of the petitioner.

(iii) If petitioner tamper with the evidence in the case, prosecution will be at liberty to move for cancellation of bail bond of the petitioner.
