02-03-2021 Heard learned counsel for the parties.

The petitioner seeks bail in Nawada (Kadirganj) P.S. Case No. 517 of 2019 registered for the offence under Sections 341, 323, 379, 385, 387, 504, 506, 34 of the Indian Penal Code.

As per the prosecution case, while informant was coming from his vehicle near Sakri river, this petitioner alongwith other accused persons, named in the FIR armed with pistol, stopped him and thereafter, it is alleged that accused persons asked the informant to inform the Balu Thikedar to give Rangdari and co-accused Rajesh Yadav snatched Rs. 20,000/- (twenty thousand) from his pocket on the point of pistol. It is submitted on behalf of petitioner that there is no specific allegation against this petitioner and co-accused Rajesh Yadav, against whom there is allegation of snatching

Patna High Court CR. MISC. No.1112 of 2021(2) dt.02-03-2021 2/2 money, has already been granted bail by this Court, vide order dated 07.08.2019 passed in Cr.Misc. No. 47918 of 2019 (Annexure-3). Petitioner is in custody since 04.06.2020. Chargesheet has already been submitted.

Considering the aforesaid facts and circumstances as well as nature of accusation, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Nawada (Kadirganj) P.S. Case No. 517 of 2019 on the following conditions:

"(1) Petitioner shall cooperate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present, as directed by the Court and on his absence on two consecutive dates without sufficient reason, his bail-bond shall be cancelled by the Court below.

(2) If the petitioner tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail."
