====================================================== CORAM: HONOURABLE MR. JUSTICE SANDEEP KUMAR ORAL ORDER 16-09-2025 Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners seek regular bail in connection with Sikta P.S. Case No. 64 of 2025, registered for the offences punishable under Sections 21(b) and 23(b) of the N.D.P.S. Act.

3. The recovery is of 234 gms. of Smack from the petitioner which is an intermediate quantity.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is in custody since 30.04.2025 and claims clean antecedents.

5. Learned A.P.P. has vehemently opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount to the satisfaction of the learned Court of Exclusive Special Judge (N.D.P.S.), West Champaran at Bettiah/concerned Court below in connection with Sikta P.S. Case No. 64 of 2025 subject to following conditions:- (i) Both the bailors will be close blood relatives of the petitioner.

(ii) the petitioner shall mark his attendance at Sikta Police Station on every Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bonds of the petitioner.

(iii) Before accepting the bail-bond of the petitioner, the court below will verify the antecedent of the petitioner. If the petitioner is found having clean antecedent, the bail-bonds of the petitioner shall be accepted. If the petitioner is found having criminal antecedent(s), his bail-bonds shall not be accepted by the court below.
