29-01-2020 From perusal of order dated 30-07-2019, it appears that petitioner was granted provisional bail and matter was referred to the Mediation Centre, Patna High Court for mediation and it was directed to place this matter after receipt of report of the Mediator. The Mediator has sent its report, which is kept at flag 'P' and from perusal whereof, it appears that mediation has failed due to non-appearance of opposite party no. 2.

It is submitted by learned counsel for the petitioner that though, the petitioner was interested in settlement, but due to non-appearance of complainant/opposite party no. 2, the mediation failed. It is further submitted that in other case, which was filed by the complainant with similar allegation, the

Patna High Court CR. MISC. No.46252 of 2019(3) dt.29-01-2020 2/2 petitioner has already been granted bail by this Court, vide order dated 04-12-2019 passed in Cr.Misc. No. 45491 of 2019. It is submitted that petitioner has falsely been implicated in this case, which is of civil in nature.

Under the aforesaid facts and circumstances, the provisional bail, granted by this Court vide order dated 30-07-2019, is hereby confirmed.
