JUSTICE BIRENDRA KUMAR ORAL ORDER 01-11-2018 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 294(A) 420 of the Indian Penal Code, 4/5 Bihar Ban on Lottery Act 1993 and Section 7(3) Lottery Regulative Act.

Lottery tickets etc were recovered from the house of co-accused-Rakesh Ranjan. The petitioners are said to have fled away from there. Others were apprehended. Petitioners have stated on oath that they have got no criminal antecedent.

Considering the nature of allegation and statement of the petitioners that they have got no criminal

No.59312 of 2018 (3) dt.01-11-2018 2/2 antecedent, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000 (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with K.Hat P.S.Case No. 325 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
