The petitioner seeks bail in Garkha P. S. Case No. 188 of 2019 instituted for the offence under Section(s) 363 of the Indian Penal Code. Later on Section 365 of the I.P.C. was added.
Learned counsel for petitioner submits that petitioner is not named in the written report.
In the written report, it is alleged that daughter of informant, namely, Aarti Kumari and Sulekha Kumari had gone to Asthayam and they did not return. Both the victim girl have given their statement U/s 164 Cr.P.C. which are annexed as Annexure-2 series , wherein, they have stated that they have
Patna High Court CR. MISC. No.46028 of 2019(2) dt.31-07-2019 2/2 gone with this petitioner to Kolkata and this petitioner has performed marriage with one of the daughter of informant, namely, Arti Kumari. Both the victims have stated that petitioner did not commit any illegal act with them.
Petitioner is in custody since 24.4.2019 having no criminal antecedent.
Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate -XIVth Saran at Chapra, in connection with Garkha P. S. Case No. 188 of 2019 subject to the condition that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) shyambihari/- U T
