JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 27-09-2021 Mr. Nadim Seraj, learned G.P. 5 has placed before this Court a copy of the minute of the meeting of the Remission Board held on 27.08.2020. Learned counsel submits that in the said meeting, the case of the petitioner was also considered and finally a decision has been taken to recommend premature release of the petitioner. Learned G.P. 5, therefore, submits that writ application has become infructuous. He has further

Patna High Court CR. WJC No.100 of 2021(3) dt.27-09-2021 2/2 informed this Court that pursuant to the said recommendation of the Board the petitioner is likely to be released very soon, if not already released.

Learned counsel for the petitioner submits that the decision of the Remission Board is that of 27th August, 2021 and about one month has gone thereafter but so far as he knows, the petitioner has not been released so far.

This writ application is being disposed of taking note of the submission of learned G.P. 5 as above. It is expected that the competent authority shall act in accordance with the decision of the Board as early as possible and preferably within a period of two weeks from the date of communication of this order, if the recommendation has remained pending so far.
