Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner is seeking regular bail in connection with Rajpur P.S. Case No. 118 of 2021, registered for the offences punishable under Sections 120 (B), 420, 498 (A), 489 (C) of the Indian Penal Code.
As per allegation, a raid was conducted in the house of the petitioner and one punching machine and counterfeit notes were recovered from his house.
The learned counsel for the petitioner has submitted
Patna High Court CR. MISC. No.46704 of 2022(2) dt.07-12-2022 2/3 that the petitioner is innocent and has falsely been implicated in this case. The counterfeit notes and punching machine were not recovered from his conscious possession, rather, it was recovered from his joint house and on similar ground, the other family members of the petitioner have been granted regular bail, vide order dated 21.04.2022 in Criminal Miscellaneous No. 66419 of 2021 and Criminal Miscellaneous No. 66647 of 2021 vide order dated 21.04.2022. He has submitted further that the petitioner is a person of clean antecedent and he is under custody since 16.06.2021.
Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned ADJ-XI, Buxar in connection with Rajpur P.S. Case No. 118 of 2021, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
(ii) If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for
Patna High Court CR. MISC. No.46704 of 2022(2) dt.07-12-2022 3/3 cancellation of the bail of the petitioner and the learned court below will take decision in accordance with law.
Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
