This application, for grant of anticipatory bail, arises out of Alamganj P.S. Case No. 304/2017, disclosing offence under Section 304B of the Indian Penal Code.

Learned counsel for the petitioners has submitted that there is no allegation of any demand of dowry in the F.I.R. No allegation under Section 304B of the Indian Penal Code is made out. It is further submitted that the informant herself disclosed in the F.I.R. that the deceased was mentally ill.

It is the case of the prosecution that the deceased had committed suicide.

Patna High Court Cr.Misc. No.48906 of 2017 (2) dt.17-11-2017 2/2 Considering the facts aforesaid, this application is allowed. Let the petitioners above named, in the event of their arrest or surrender before the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Patna City, Patna in connection with Alamganj P.S. Case No. 304/2017, subject to the condition laid down under Section 438(2) of the Cr.P.C.

This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bond shall be liable to be cancelled.
