JUSTICE ASHUTOSH KUMAR ORAL ORDER 22-01-2019 The petitioner seeks bail in anticipation of his arrest in connection with Jhanjharpur P.S. Case No. 164 of 2017 dated 10.12.2017 instituted for the offences under Sections 147, 148, 149, 282, 144, 188, 353, 427, 341, 323, 504, 333 of the Indian Penal Code.
The learned counsel for the petitioner has submitted that though petitioner is named in the F.I.R but nothing specific has been attributed to him.
The allegation in the F.I.R is that irked by the accidental death of a person on road, people of the neighborhood created a blockade of N.H.-57 and resorted to loot and arson. In the process, certain properties of the
Patna High Court Cr.Misc. No.57812 of 2018(3) dt.22-01-2019 2/2 Government also were damaged.
Regard being had to the nature of accusation against the petitioner which is absolutely general and also taking into account his clean antecedents, the petitioner above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1, Jhanjharpur, Madhubani in connection with Jhanjharpur P.S. Case No. 164 of 2017, G.R. No. 1796 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
