Heard counsel for the State.

The writ application prays for a direction upon the respondents not to construct the road on his Raiyati land.

Counsel for the State, referring to diverse statements made in the counter affidavit, particularly those in paragraph 8 and 9, contended that the application has become infructuous as the portion of the road on the Raiyati land has been stopped and the construction made therefrom has been removed. There is no rejoinder to the said counter affidavit.
