In this case, the petitioners are seeking anticipatory bail in connection with Barsoi P.S. Case No. 134 of 2019, registered for the offence punishable under Section 30 (a) of Bihar Prohibition and Excise Act.

The police has recovered 236 liters of foreign liquor from a pick up van, however, the petitioners fled away. One person has been arrested, who has disclosed the name of the petitioners. The petitioner no.1 has also got criminal antecedent in similar nature.

Looking to the nature of allegation, this Court is

Patna High Court CR. MISC. No.45088 of 2019(2) dt.22-07-2019 2/2 not inclined to grant bail to the petitioners. Accordingly, the prayer for bail is rejected. However, if the petitioners surrender before the Court below within four weeks from today and pray for regular bail, the Court below will consider the same and pass appropriate order without being influenced by the order of this Court.
