The petitioner apprehends his arrest in connection with Manigachhi (Nehra O.P) P.S. Case no. 49 of 2018, registered under Sections 341, 323, 354, 504, 506, 385, 120(B) and 509 of the Indian Penal Code and Sections 67, 67(A) and 67(B) of the I.T. Act.

The accusation is that the informant was studying in Nagendra Jha Women College, Laheriasarai in between 2012-15 and used to reside at her uncle's house. She was taking tuition of English subject from K.K. Jha. In that course, she came in touch of petitioner, who was also taking tuition from that teacher. It is alleged that petitioner has taken some

Patna High Court Cr.Misc. No.60221 of 2018(4) dt.01-02-2019 2/3 photographs from his mobile and later on he started blackmailing her. In the year 2016, she admitted in B.I.T. Mesra Ranchi and started live there in private hostel. The petitioner used to visit there and gave threatening to show the photographs in the college and also told her if she will not obey his direction then her photographs will be viral. Due to fear, she gave money to the petitioner on several occasions. In spite of that he forcibly took her in a room in house situated in Dipa Toli, Ranchi, where she talked to mother of petitioner, who told that do according to wish of petitioner. Thereafter, petitioner used to give pressure to arrange Rs. Two lakhs from her parents, but she made protest. Thereafter, petitioner used to talk on mobile to her parents. On 01.03.2018, her elder uncle along with some persons went at the village of the petitioner, but parents of the petitioner were also in support of the petitioner.

Learned counsel for the petitioner submits that, in fact, there was love affair in between the petitioner and the informant, but due to some misunderstanding, the present case has been lodged, now, the misunderstanding has been removed in between them and compromise petition, in this regard, has also been filed on 23.05.2018 in the Court of Sri R.K. Dwivedi,

Patna High Court Cr.Misc. No.60221 of 2018(4) dt.01-02-2019 3/3 Addl. Chief Judicial Magistrate-V, Darbhanga. Learned counsel appearing on behalf of the informant submits that now the matter has been pacified in between the petitioner and O.P. No.2 and there is no dispute in between them.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate-V, Darbhanga in connection with Manigachhi (Nehra O.P) P.S. Case No. 49 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
