The petitioner seeks bail in Kaithar Rail P.S. Case No. 82/2018, instituted for offence under Section(s) 401, 414/34 of the Indian Penal Code read with Sections 137 and 147 of Indian Railway Act.
It is alleged in the written report that on the date of occurrence informant/A.S.I. was on platform duty. He saw three persons started running away seeing the police party but on chase they were apprehended. They disclosed their name as Rohit Kumar Sah, Md. Mubarak and Vijay Kumar Sah (petitioner). It is alleged that from possession of petitioner one mobile phone, Aadhar Card of one Md. Tabrej and Rs. 90/- were recovered. He disclosed that aforesaid articles were snatched

Learned counsel for the petitioner has submitted that petitioner is in custody since 28.09.2018.
Keeping in view the period spent by petitioner in custody, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Railway Judicial Magistrate, Katihar, in connection with Kaithar Rail P.S. Case No. 82/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) rakhi/- U T
