JUSTICE SANJAY PRIYA ORAL ORDER 02-11-2017 Heard learned counsel for the petitioners and the State. The petitioner apprehends arrest in Gaya Muffasil P.S. Case No. 89 of 2017 instituted for the offence under Sections-304B/34 of the Indian Penal Code.

The petitioner is husband of the deceased.

In the written report, there is allegation against this petitioner that he committed murder of the deceased by causing her burn injury. The postmortem report supports that deceased died due to burn injury. The learned Sessions Judge has mentioned in the impugned order that the deceased herself had given written note to the informant making allegation against the petitioner as mentioned in para-17 of the case diary.

Therefore, this court is not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer for anticipatory bail stands

The petitioner is directed to surrender in the court below and seek regular bail which will be considered and disposed of preferably on the same day on its own merit without being prejudiced by this order.
