This application for anticipatory bail arises out of Budha Parbatta P.S.Case N0. 84 of 2011, disclosing offences under Sections 302/307/34 of the Indian Penal Code and Section 27 of the Arms Act.

For the two reasons, I am not inclined to grant the privilege of anticipatory bail to the petitioners. Firstly, the petitioners have approached this Court seven years after registration of the First Information Report. Secondly, the offence alleged is punishable under Section 302 of the Indian Penal Code.

This application is, accordingly, rejected.

The petitioners are directed to surrender before the Court

Patna High Court Cr.Misc. No.43175 of 2017(2) dt.21-09-2017 2/2 below within four weeks from today and seek regular bail, if so advised. If they do so, their application for regular bail shall be considered on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail by this Court.
