The present criminal miscellaneous application has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'the BNSS, 2023') for grant of anticipatory bail to the petitioner, who apprehends arrest in connection with Vijaypur P.S. Case No. 185 of 2025, lodged on 19.06.2025, under Sections 420/465/467 /468 /471 / 120B of the Indian Penal Code, pending in the Court of learned ACJM-VI, Gopalganj.
3. As per the prosecution, the petitioner has filed forged certificate to get a fresh passport in spite of the fact that earlier also a passport was issued to him whose validity was 10.04.2025 in which date of birth was marked as 08.07.1988,
Patna High Court CR. MISC. No.48536 of 2026(2) dt.22-07-2026 2/3 but currently he has shown his date of birth as 10.05.1997.
4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He submits that the petitioner has not prepared any forged document, impersonated any person or personally submitted any false document before the passport authority. He submits that petitioner is not a public servant connected with the passport office but his only fault is that he contacted an agent who applied for new certificate. He submits that discrepancy in the date of birth and procurement of two passports is just a mistake and not an intentional one. He submits that the petitioner is illiterate and belongs from a poor family has minimum knowledge and some agent lured the petitioner with the promise of getting job abroad. He submits that the petitioner is not named in the FIR. His name has figured only because he is the passport holder but all the misconduct and willful and deliberate act was done by the agent. Counsel submits that antecedent of the petitioner is clean and he is ready to fulfill all the conditions whatsoever shall be imposed upon him.
5. Learned APP for the State opposes the prayer for bail of the petitioner and submits that with the help of an agent the petitioner has forged his document to obtain a new passport

6. Considering the serious nature of allegation against the petitioner, the prayer for anticipatory bail of the petitioner is hereby refused. However, in the event of surrender of the petitioner within four weeks from today, the prayer for regular bail shall be considered on the same day without being prejudiced by the order of this Court.
