JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 12-12-2018 Heard learned counsel for the petitioners and counsel appearing on behalf of the State as well as Complainant. The petitioners are apprehending their arrest in connection with Complaint Case No. 567 of 2017 for the offence under Sections 406 and 417 of the Indian Penal Code. Learned counsel for the petitioners would submit that petitioners have no criminal antecedent. He further submits that case lodged against the petitioners in connection with forceful possession of the bus by the informant and also reference to the case of criminal breach where the Court granted indulgence and directed to confiscate the vehicle. He submits that present case
Patna High Court Cr.Misc. No.53898 of 2018(4) dt.12-12-2018 2/2 is pressure tactics to exploit to the petitioner. Considering the totality of the facts situation which indicates that it is precisely a money dispute and considering the aforesaid fact Court is inclined to grant anticipatory bail to the petitioners, let the petitioners above named, in the event of arrest or surrender within one moth from today, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Judicial Magistrate 1st Class, Danapur in connection with Complaint Case No. 567 ( C) of 2017, subject to the conditions as laid down under Section 438 Cr.P.C.
