The petitioner seeks bail in connection with Desari P.S. Case No. 08 of 2020 instituted for the offences under Section 120(B) of the Indian Penal Code read with Sections 25(1-b)a, 26 and 35 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 15.05.2020, charge-sheet has been submitted in the case and has antecedent of two cases. Learned counsel for the petitioner submits that from bare perusal of the allegation as alleged in the F.I.R. it would manifest that nothing was recovered from the possession of the petitioner and as far as recovery of arms is concerned, the same was made from the possession of accused Rahul Kumar.

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 15.05.2020, charge-sheet has been submitted in the case and nothing was recovered from his possession, let the petitioner above named be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Vaishali at Hajipur in connection with Desari P.S. Case No. 08 of 2020 with a condition that one of the bailor shall be the father of the petitioner (Banbari Rai).
