2. The petitioners apprehend their arrest in connection with Barauli P.S. Case No. 22 of 2025 registered for the offences punishable under Sections 126(2), 115(2), 118(1), 351(2), 351(3), 117(2), 109(1) and 3(5) of the BNS, 2023.

3. As per prosecution case, it is alleged that on 30.01.2025 at about 04:45 P.M., the petitioner no. 1 and petitioner no. 2, along with others came armed with sword and lathi and assaulted the informant. Petitioner no. 1 allegedly gave a sword blow on the head of the informant, while petitioner no. 2 assaulted him with a lathi causing injury and fracture on his hand. It is further alleged that the informant's wife and son were also assaulted. Thereafter, the accused persons fled away from the place of occurrence.

4. The learned counsel for the petitioners has submitted

Patna High Court CR. MISC. No.46151 of 2025(5) dt.11-02-2026 2/2 that both the parties are own brothers. There is case and countercase between them. Both the parties have suffered injuries and the petitioners are persons of clean antecedents.

5. On the other hand, the learned counsel for the informant has opposed the prayer for bail by submitting that both the parties have suffered grievous injuries. Learned counsel for the petitioner replied that there is only one injury on the person of the injured.

6. Both the parties are own brothers. Both sides have filed cases against each other.

7. Considering the above-mentioned facts and circumstances, let the petitioners, in the event of their arrest or surrender within four weeks before the learned court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-Ist Class, Gopalganj/concerned court in connection with Barauli P.S. Case No. 22 of 2025, subject to the conditions as laid down under Section 438(2) Cr.P.C.
