The petitioner seeks bail in a case registered for the offence punishable under Sections 395 & 414 of IPC. FIR was lodged against unknown.
During investigation, the petitioner was arrested.
It is submitted that during investigation, the petitioner and three others were arrested in Bihata P.S. Case No. 368 of 2013 in which they made confession before the police and thereafter they have been remanded in this case. The petitioner has been in custody since 25.6.2013. Nothing has been recovered from his possession nor he was put on T. I. Parade.
It is further submitted that in similar facts and circumstances, co-accused has been granted bail by the court below.
Patna High Court Cr.Misc. No.45759 of 2014 (3) dt.19-03-2015 2/2 Learned counsel for the State submits that the petitioner has criminal antecedents. After investigation the case has been found true against him and charge-sheet has already been submitted.
Considering the facts and circumstances, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Patna City/court concerned in Fatuha P. S. Case No. 52 of 2013 after framing of charge with following conditions:-
1. The petitioner will not indulge himself in similar or any other offence.
2. One of the bailors must be the close relative of the petitioner.
3. The petitioner will be well represented in the Court on each and every date and in case of absence for two consecutive dates or in case of violation of terms of bail, his bail bond would be liable to be cancelled by the learned Court concerned.
