12-07-2017 Heard Smt. Kumari Sujata Sinha, learned counsel for petitioners and Sri Damodar Prasad Tiwary, learned Addl. Public Prosecutor.
Two petitioners, who are husband and father-in-law of opposite party no. 2 apprehending their arrest in Complaint Case No. 1457 of 2015 for offence under Section 498(A) of the Indian Penal Code, have prayed for grant of anticipatory bail. Earlier, by order dated 26-04-2017, notice was directed to be issued to complainant/opposite party no. 2. Despite valid service of notice, opposite party no. 2 has preferred not to appear.

No.15162 of 2017 (6) dt.12-07-2017 2/2 Considering the fact that complainant/opposite party no. 2, despite valid service of notice, has not appeared, in the event of arrest or surrender within a period of six weeks from today, let both the petitioners namely Chandra Mohan Sahni and Nathuni Sahni be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Sunil Kumar Tripathy, J.M. Ist Class, Muzaffarpur in connection with Complaint Case No. 1457 of 2015, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
