This application has been filed for quashing the order dated 03.09.2014 passed by learned ACJM, Patna City in Complaint Case No. 522 of 2014.

The present case has been filed by the O.P. No. 02 only because the claim of the O.P. No. 02 is repudiated by the Birla Sun Life Insurance.

If the O.P. No. 02 had any grievance, she should have filed an application under the Consumer Protection Act. In the opinion of this Court, it is malicious proseuction and no criminal case is made out and therefore the same cannot be allowed to proceed.

Patna High Court CR. MISC. No.42009 of 2022(3) dt.16-05-2023 2/2 Accordingly, the order dated 03.09.2014 passed by learned ACJM, Patna City in Complaint Case No. 522 of 2014 is hereby quashed.
