JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-07-2019 This application, for grant of anticipatory bail, arises out of Sarmera P.S. Case No. 73 of 2019, disclosing offences under Sections 366(A)/34 of the Indian Penal Code. Allegation against the petitioner and others is that they enticed away the minor daughter of the informant. Submission of learned counsel for the petitioner is that in this case, statement of the girl under Section 164 Cr.P.C. has been recorded, in which, she has not named the petitioner rather she has disclosed that she had gone out of her own will with the co-accused Raja Kumar and none has enticed her away. Heard learned A.P.P. also.

Having heard both sides, in view of the above facts,

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -IV, Nalanda at Biharsharif, in connection with Sarmera P.S. Case No. 73 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
