The sole petitioner, apprehending his arrest in Dumariyaghat P.S. Case No. 06 of 2017 , registered for the offence under Section 272/ 273 / 34 of the Indian Penal Code and Section 30(a) of the Bihar Excise Act , has prayed for grant of anticipatory bail.
It was submitted by learned counsel for the petitioner that petitioner has been made accused on the basis of confessional statement of one of the accused, from whose sweet shop 2 liter 400 ml country made liquor was recovered Considering the fact that petitioner's name has come
Patna High Court Cr.Misc. No.17824 of 2017 (2) dt.13-07-2017 2/2 on the basis of disclosure made by the co- accused , there is no reason to refuse the prayer for anticipatory bail. Accordingly, in the event of arrest or surrender within a period of six weeks from today, let the petitioner Bihari Rai @ Bihari Kumar be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran / concerned court in connection with Dumariyaghat P.S. Case No. 06 of 2017 subject to the conditions as contemplated under section 438(2) of the Code of Criminal Procedure 1973 .
