In this case, the petitioner is seeking anticipatory bail in connection with Gwalpara P.S. Case No. 71 of 2019 (G.R. No.453 of 2019), registered for the offence under Sections 392 of the Indian Penal Code.

Allegation has been made that while the informant, who is the Senior Deputy Collector, Madhepura, was proceeded for Madhepura from Alamnagar along with his driver and Executive Assistant in his Government vehicle, at that time three persons in drunken condition, riding on a motor-cycle went ahead by driving the motor-cycle negligently. When the motor-cycle was intercepted, they stopped the motor-cycle and

No.43770 of 2019(2) dt.16-07-2019 2/2 one person holding a bottle of wine came near the vehicle and started quarreling with the informant, upon which the driver and Executive Assistant got down from the Government vehicle and snatched the bottle from the hand of the said person. At that time, the other companion motor-cycle riders also came there and the said persons started scuffling with the informant and demanded the said bottle. In that course, the Executive Assistant snapped the photo of said person by his mobile. When the photograph was shown to the people, who were present there, they identified him as Sonu Singh, present petitioner. Looking to the nature of allegation as also the fact that the petitioner has criminal antecedent, this Court is not inclined to grant bail to the petitioner.

Accordingly, the prayer for bail is rejected. However, if the petitioner surrenders before the Court below within three weeks from today and prays for regular bail, the Court below will consider the same and pass appropriate order without being influenced by the order of this Court.
