2. The petitioner apprehends his arrest in connection with Maniyari P.S. Case No. 239 of 2024, instituted under Sections 80, 3(5) of the B.N.S.

As per the prosecution story, which has been lodged on the basis of the written report submitted by the informant to the effect that his daughter was married on 26.04.2023 in accordance with Hindu Customs with Prabhat Ranjan. In the marriage, he gave Rs. 5,00,000/- in cash along with gold ornaments. His daughter went to her matrimonial house and lived there happily for two months, however later on her husband along with her in-laws started demanding a Bolero vehicle in dowry and when the same was not being fulfilled by
2/5 the informant, she was used to be tortured. When the informant tried to pacify the matter, nothing happened and they kept on demanding dowry from the daughter of the informant. On 30.09.2024 at around 06:00 in the morning, he received information on his mobile from the in-laws family of his daughter that she has committed suicide by hanging herself. When he reached there he came to know that she has been killed for dowry by her father-in-law, mother-in-law, husband, dewar (petitioner) and her two nanad.
4. The learned counsel for the petitioner submits that the petitioner had earlier filed anticipatory bail petition bearing Cr. Misc. No. 36507 of 2025 along with other co-accused persons, however the same was permitted to be withdrawn. He submits that he has filed the present anticipatory bail petition since new facts have come and in the changed circumstances, he has renewed his prayer for anticipatory bail. He submits that the case of his brother namely, Prabhat Ranjan, who is husband of the deceased lady has been bifurcated and the case has been committed for trial. The same has been numbered as Sessions Trial No. 490 of 2025. In the said sessions trial, the deposition of the informant namely, Mishri Lal Thakur was recorded on 22.05.2026, wherein during course of his cross-examination he
3/5 had stated that his daughter was not tortured by his in-laws family and no demand was being made. He further stated that someone from the matrimonial home of the his daughter gave incorrect informant and on the basis of the same, he filed the present case. He further said that the in-laws family of his daughter were not involved and they are not at fault. He later came to know that his daughter has committed suicide. The learned counsel for the petitioner submits that on the same date the informant gave a petition before the Court of learned District and Additional Sessions Judge-V, in Sessions Trial No. 490 of 2025 that a compromise has been entered into between the parties and he be permitted to compromise the case.
Further a joint compromise petition was also filed in between the husband of the deceased and the informant in Sessions Trial No. 490 of 2025 on 22.05.2026. The learned counsel for the petitioner submits that in view of the changed circumstances and subsequent development the prayer for anticipatory bail petition on behalf of the petitioner has been renewed. He submits that the petitioner has got a clean antecedent.
5. Per contra, the learned APP appearing on behalf of the State opposes the prayer for bail of the petitioner and submits that the petitioner had withdrawn his earlier anticipatory
4/5 bail petition and now he has filed second anticipatory bail petition, which is not permissible.

Having considered the rival submissions and after going through the record, it appears that the petitioner had earlier withdrawn his anticipatory bail petition on 04.12.2025 and in view of the subsequent development, wherein the informant in course of Sessions Trial No. 490 of 2025, in his deposition submitted that there is no fault on the part of the inlaws family of his deceased daughter and he had filed the case due to incorrect information provided to him. He further stated in his deposition that later on he came to know that his daughter has committed suicide. On the same day i.e. 22.05.2026 he filed a petition for permission to compromise before the learned District & Additional Sessions Judge-V in Sessions Trial No. 490 of 2025 and also filed a compromise petition on the same day with the husband of the deceased.
Considering that the informant himself gave statement in his deposition that the inlaws family of his deceased daughter are not involved in her death and he has also filed a compromise petition, let the petitioner, above named in the event of arrest/surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.
5/5 Additional Chief Judicial Magistrate VIIIth, (West), Muzaffarpur or the concerned Court in connection with Maniyari P.S. Case No. 239 of 2024, subject to the conditions as laid down under Section 482(2) of the B.N.S.S. and subject to the following condition:- (I) That the learned court concerned shall verify the criminal antecedent of the petitioner and in case at any stage, it is found that the petitioner has concealed his criminal antecedent, the court concerned shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.
