The petitioner seeks bail in connection with Bairiya P.S. Case No. 364 of 2020 for the offence under Sections 147, 341, 323, 324, 307, 504 and 506 of the Indian Penal Code.
Learned counsel appearing for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, the injury report itself falsifies the prosecution version of giving a blow by sword because the informant sustained only one simple injury caused by a hard and blunt substance, which is evident from Annexure-2, therefore, no case under Section
Patna High Court CR. MISC. No.3233 of 2021(2) dt.17-06-2021 2/2 307 of the Indian Penal Code is made out against the petitioner. The petitioner is rotting in judicial custody since 05.08.2020.
Considering the facts and circumstances of the case, let the, above named, petitioner be released on bail on furnishing his personal bond to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Bairiya P.S.
