1. Learned counsel for the petitioners at the outset seeks permission to withdraw the prayer for anticipatory bail with respect to petitioner no. 2 Ram Kumar Yadav @ Bubu Yadav.

2. Permission is accorded.

3. Accordingly, the prayer for anticipatory bail with respect to petitioner no. 2 is dismissed as withdrawn.

4. Heard learned counsel for the petitioner no. 1 and learned A.P.P. for the State.

5. The petitioner no. 1 apprehends her arrest in a case registered for the offences punishable under Sections 323, 379, 307 and 504/34 of the Indian Penal Code.

6. Learned counsel for the petitioner no. 1 submits

Patna High Court CR. MISC. No.48654 of 2023(2) dt.08-08-2023 2/3 that petitioner no. 1 is a person with clean antecedent and is a woman.

7. The informant alleges that he was called by his cousin sister-in-law for repayment of the loan at her house and when he went to the place he was assaulted by Ram Kumar Yadav @ Bubu Yadav by farsa causing injury on his head and petitioner no. 1 assaulted by fists and legs and snatched his gold chain, thereafter he was taken to PHC, Keoti from where he was referred to DMCH, Darbhanga.

Learned counsel for the petitioner no. 1 submits that from perusal of the allegation as alleged in the FIR, it would manifest that the allegation of assault is against Ram Kumar Yadav @ Bubu Yadav and the injury suffered by the injured, no doubt, is grievous but then the petitioner no. 1 is not alleged to have assaulted.

9. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

10. Considering the submissions made by the learned counsel for the petitioner no. 1, the petitioner no. 1 abovenamed, in the event of her arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of

Patna High Court CR. MISC. No.48654 of 2023(2) dt.08-08-2023 3/3 Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Keoti P.S. Case No. 99 of 2023, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
