The petitioner apprehends his arrest in Maner P.S. case No. 182 of 2019 registered under Section 30(a) of the Bihar Prohibition & Excise Act.

The informant alleged that he got information that Md. Sonu and his one friend were selling liquor by the side of road. The informant proceeded for verification of information and saw two persons fleeing away. On chase one Md. Sonu was apprehended and from his possession 70 liters of country made liquor was recovered. Md. Sonu is said to have disclosed the name of petitioner.

The learned counsel for the petitioner submits that nothing has been recovered from the possession of the petitioner. The petitioner was not selling the liquor. It was Md.

Patna High Court CR. MISC. No.47312 of 2019(2) dt.30-07-2019 2/2 Sonu who was selling the liquor and he on account of enmity disclosed the name of petitioner.

Considering the facts aforesaid and nature of allegation made against the petitioner, the petitioner, above named, in the event of his arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Patna in connection with Maner P.S. case No. 182 of 2019, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
