The petitioner apprehends his arrest in a case registered for the offence under Section 307 & other allied sections of the Indian Penal Code.
As per the prosecution case, this petitioner is alleged to have assaulted with butt of revolver.
Doctor has found the injury, caused by this petitioner, to be simple in nature. There is case and counter case. Petitioner has got clean antecedent.
Learned counsel for the informant vehemently opposes the prayer for anticipatory bail and submits that petitioner is named in the F.I.R. and there is specific allegation against him of causing assault by butt of revolver. The injured sustained four injuries, out of which, one injury is grievous in nature.

No.47425 of 2022(2) dt.08-12-2022 2/2 Considering the fact that injury caused by this petitioner is simple in nature coupled with the fact that petitioner has got clean antecedent, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Saran at Chapra in connection with Mashrakh P.S. Case No. 113 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
