2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 406/420/409 of the Indian Penal Code.

3. As per the prosecution case, petitioner did not complete the work within the stipulated period.

4. Learned counsel appearing for the petitioner submits that it is not the case of defalcation and from the FIR itself it is clear that the petitioner has already completed the work, belatedly.

5. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of

Patna High Court CR. MISC. No.50429 of 2023(2) dt.17-08-2023 2/2 Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Rohtas at Sasaram in Kargahar Police Station Case No. 14 of 2020, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
