The petitioner seeks pre-arrest bail in connection with Buxar (Town) P.S.Case No.372 of 2018 registered under Sections 406, 420 and 120B of the Indian Penal Code. It is submitted by the learned counsel for the petitioner that the informant is vendee and after being satisfied with the vendor, she has purchased the land in question in the year, 2015 but after lapse of about two years of execution of registered deed, she got the case instituted alleging therein that she has not got possession over the land. He contended that as far as the petitioner is concerned he is merely a witness of the

Patna High Court Cr.Misc. No.61029 of 2018(3) dt.12-12-2018 2/2 sale deed. She had neither received any amount of money from the complainant nor executed the sale deed.

On the other hand, learned counsel for the informant contended that though negotiation was made for a different piece of land, another plot was sold by the vendor in connivance with the peitioner.

Considering the nature of dispute in the event of arrest or surrender before the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Buxar (Town) P.S. Case No.372 of 2018 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
