The petitioner seeks bail in Industrial Area P.S. case no. 225 of 2018 instituted for the offence under Section(s) 302 of the IPC and Section 27 of Arms Act.

Learned counsel for petitioner submits that petitioner is not named in the written report.

In the written report, it is alleged that on the date of occurrence some miscreants shot dead son of informant, namely Gunjan Khemka, near the factory gate in the industrial area. It appears that name of the petitioner has surfaced in the statement of co-accused Abhishek Kumar @ Mastu. Besides, the aforesaid confessional statement, there is no

No.44326 of 2019(2) dt.22-07-2019 2/2 allegation of any specific overt act against this petitioner as it would appear from the impugned order passed by Sessions Judge Vaishali at Hajipur. The other co- accused of this case has already been granted regular bail by co-ordinate Bench of this Court by order passed in Cr. Misc. no. 38881 of 2019. Petitioner is in custody since 22.4.2019.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the SDJM, Vaishali at Hajipur in connection with Industrial Area P. S. case no. 225 of 2018 subject to the condition that both the bailors shall be the close relative of the petitioner.
