JUSTICE MUNGESHWAR SAHOO ORAL ORDER 04-02-2015 Heard the learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners namely, Bihari Rajak and Chandrawati Devi are in custody since 09.08.2014 in Chauri P.S. Case No.48 of 2014 u/s 366A I.P.C.

According to the prosecution case, the petitioners who are husband and wife enticed the informant's daughter for marrying her with their son, Akhilesh.

The learned counsel for the petitioners submitted that in fact, the daughter of the informant has come to the house of the petitioners to take some books from the son of the petitioners as both of them are reading in the same school. The informant's

Patna High Court Cr.Misc. No.45635 of 2014 (2) dt.04-02-2015 daughter has been examined under Section 164 Cr.P.C. wherein she has stated that her father lodged the F.I.R. because of misunderstanding the facts.

Considering the aforesaid facts and circumstances of the case and the nature of allegation against these petitioners, I direct that both the above named petitioners be released on bail on furnishing bail bond of Rs.10,000(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Ara(Bhojpur) in connection with Chauri P.S. Case No.48 of 2014.
