10-12-2021 Heard learned counsel for the parties through video conferencing.

Petitioners pray for bail in Ramgarh P.S. Case No. 285 of 2018 (Sessions Trial No. 201 of 2021), registered for the offence under Section 395 of the Indian Penal Code. As per the F.I.R., while the informant was changing the punctured tyre of his Bolero Jeep, five unidentified persons came and snatched Rs. 5,000/- cash from his pocket and also took away his Bolero Jeep.

It is submitted on behalf of petitioners that name of petitioners has come during course of investigation on the basis of confessional statement of co-accused Sugriv Ram, who has

Patna High Court CR. MISC. No.56798 of 2021(2) dt.10-12-2021 2/2 already been granted bail by this Court, vide order dated 04.12.2019 passed in Cr.Misc. No. 72125 of 2019. No incriminating article has been recovered from the possession of petitioners and till date, they have not been put on T.I.P. Similarly situated two other co-accused namely Kabindra Kohar and Bharosi Ram have also been granted bail by this Court, vide order dated 06.03.2020 passed in Cr.Misc. No. 71622 of 2019 and order dated 17.03.2020 passed in Cr.Misc. No. 74273 of 2019 (Annexure 2 series). Petitioners are in custody since 13.01.2021.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioners is allowed. Let the above named petitioners be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Kaimur at Bhabua in connection with Ramgarh P.S. Case No. 285 of 2018 (Sessions Trial No. 201 of 2021).
