For the Petitioner : Mr. Md. Bahauddin, Advocate For the Opposite Party: Mrs. Anusaiya Jaiswal, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR JHA ORAL ORDER 16-02-2015 Heard both sides.

Petitioner, Masique @ Md. Masique @ Masiur Rahman, seeks bail in Purnea Sadar P.S. Case No.319 of 2014, registered for the offences punishable under Section 393 of the Indian Penal Code.

The informant alleged that four persons armed with different weapons came at the godown and committed robbery. Two labourers came to apprehend them and apprehended the two accused persons who disclosed their names as Masique @ Md. Masique @ Masiur Rahman and Md. Wasimuddin.

Learned counsel for the petitioner submits that the petitioner was, of course, apprehended on the spot but he was remanded to judicial custody on 06.07.2014. It is further submitted that the petitioner had sold his maize crop to the informant and he

Patna High Court Cr.Misc. No.45030 of 2014 (3) dt.16-02-2015 2/2 had gone there for taking money.

On perusal of the record it appears that the petitioner was apprehended on the spot along with another person, namely, Md. Wasimuddin. The petitioner was earlier convicted under Section 224 of the IPC.

Considering the facts and circumstances, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.

The trial court is directed to expedite the trial and conclude the same within nine months from the date of receipt of a copy of this order.
