The appellant seeks pre arrest bail in connection with Budha Colony P.S.Case No.81 of 2017 registered for offences punishable under Sections 228(A), 120(b), 500 and 501 of the Indian Penal Code and section 3(2)(va) of SC/ST (Prevention of Atrocities) Act.

Allegation against the appellant of assisting the other co-accused persons in commission of rape by the co-accused persons.

Submissions of the learned counsel for the appellant is that there is no direct allegation against the appellant and he has been falsely made accused in this case. It has also been submitted that the other co-accused have been granted privilege of

Patna High Court CR. APP (SJ) No.2740 of 2017 (3) dt.06-11-2017 2/2 anticipatory bail from the Hon'ble Apex Court. Heard learned Special P.P. also.

Having heard both sides and in view of allegation, this appeal is not maintainable.

Let the appellant surrender before the court of learned Special Judge and make prayer for regular bail, who will consider this aspect of the matter that Ad interim bail has been granted to the other co-accused persons having similar allegation by the Hon'ble Apex Court and he will pass appropriate order without being prejudiced by the order of this Court. With the above observation, this appeal is disposed of.
